Supreme Administrative Court Judgment exacerbates asylum practice for Eritrean

Whether the new practice of SEM is justified and how the human rights situation in Eritrea presents itself is controversial. Over the past two years, international organizations, asylum authorities, non-governmental organizations and private individuals have conducted research and produced reports.
 
It was eagerly awaited by the Federal Administrative Court to assess the situation and whether it would support the new practice of the State Secretariat for Migration. As is shown in the principle decision published on Thursday, it does so. The case of a Eritrean who had been sent to Switzerland in 2014, who had asked for asylum, was to be assessed. He had fled from his home in 2013 for fear of being drafted into the military service, he claimed. The SEM dismissed the asylum application and expelled him from Switzerland. At the same time, a provisional admission was ordered due to the unreasonableness of the course of the course.
 
The court shares the view of the SEM that the illegal departure alone can not justify the refugee status. Rather, additional individual elements are necessary. The St. Gallen Instance is based on a comprehensive analysis of recent country information. It is particularly important for the court that persons from the Diaspora return home for short stays - a circumstance which has already given rise to much talk. Among these Eritrea travelers were also people who had left their home country illegally. It is also questionable whether the penal provisions of the illegal exit are still applied at all. Because of the massive "Braindrains", a certain rethinking of the Eritrean authorities seemed to have taken place: Against returnees no longer proceeded rigorously.
 
According to the Federal Administrative Court, the assumption can no longer be maintained that Eritreans are confronted with sanctions due to unauthorized departure from home or are generally regarded as traitors and severely punished. The Court of First Instance accepts such punishment risk only if additional factors are added to the illegal exit which make the asylum seeker appear as a disguised person in the eyes of the Eritrean authorities.
 
Does not apply to deserters
 
The decision concerns all pending procedures for which asylum is sought because of illegal exit. The man in question has already received the provisional admission and does not have to leave Switzerland. Whether his expulsion into the homeland was to be regarded as inadmissible or unacceptable because of the imminent confiscation of the National Service was therefore not examined. Nor is there any comment on the question of how to deal with Eritrean deserters. The judgment is final.

Eritreische Asylbewerber erhalten in der Schweiz kein Asyl mehr, nur weil sie ihr Heimatland illegal verlassen haben. Es braucht weitere Gründe, sagt das Bundesverwaltungsgericht.

Im Juni 2016 hat das Staatssekretariat für Migration (SEM) seine Praxis gegenüber eritreischen Asylbewerbern, deren Zahl sich derzeit auf rund 15 000 beläuft, punktuell verschärft. Seither wird davon ausgegangen, dass Eritreer alleine aufgrund ihrer illegalen Ausreise bei der Rückkehr mit keiner Verfolgung rechnen müssen. Aus diesem Grund erhalten sie in der Schweiz kein Asyl mehr. Eine (glaubhaft gemachte) illegale Ausreise aus Eritrea mag also nicht mehr ohne weiteres die Flüchtlingseigenschaft zu begründen. Das Staatssekretariat stützte sich bei seiner Einschätzung auf einen Bericht über die Situation in Eritrea; es hatte dafür Informationen vor Ort gesammelt und überprüft, unter welchen Bedingungen Rückschaffungen möglich sind.

Ob die neue Praxis des SEM gerechtfertigt ist und wie sich die Menschenrechtslage in Eritrea präsentiert, ist umstritten. In den letzten zwei Jahren haben internationale Organisationen, Asylbehörden, Nichtregierungsorganisationen und Privatpersonen dazu Recherchen durchgeführt und Berichte verfasst.

Mit Spannung wurde darauf gewartet, wie das Bundesverwaltungsgericht die Situation beurteilt und ob es die neue Praxis des Staatssekretariats für Migration stützt. Wie sich in dem am Donnerstag veröffentlichten Grundsatzentscheid zeigt, tut es dies. Zu beurteilen war der Fall eines 2014 in die Schweiz gelangten Eritreers, der um Asyl ersucht hatte. Er sei 2013 aus seiner Heimat geflohen aus Angst, in den Militärdienst eingezogen zu werden, machte er geltend. Das SEM lehnte das Asylgesuch ab und wies ihn aus der Schweiz weg. Gleichzeitig wurde aufgrund der Unzumutbarkeit des Wegweisungsvollzugs eine vorläufige Aufnahme angeordnet.

Das Gericht teilt die Auffassung des SEM, dass die illegale Ausreise allein die Flüchtlingseigenschaft nicht zu begründen vermag. Vielmehr seien zusätzliche individuelle Elemente nötig. Die St. Galler Instanz stützt sich dabei auf eine umfassende Analyse neuster Länderinformationen. Für das Gericht ist insbesondere von Bedeutung, dass Personen aus der Diaspora für kurze Aufenthalte in ihre Heimat zurückreisen – ein Umstand, der schon viel zu reden gegeben hat. Unter diesen Eritrea-Reisenden fänden sich auch Personen, die ihr Heimatland illegal verlassen hätten. Auch sei fraglich, ob die Strafbestimmungen der illegalen Ausreise überhaupt noch angewendet würden. Aufgrund des massiven «Braindrains» scheine ein gewisses Umdenken bei den eritreischen Behörden stattgefunden zu haben: Gegen Rückkehrer werde nicht mehr rigoros vorgegangen.

Laut Bundesverwaltungsgericht lässt sich die Annahme nicht mehr aufrechterhalten, dass Eritreer aufgrund unerlaubter Ausreise in der Heimat mit Sanktionen konfrontiert seien oder generell als Verräter betrachtet und hart bestraft würden. Ein solches Bestrafungsrisiko nimmt das Gericht nur noch dann an, wenn zur illegalen Ausreise weitere Faktoren hinzukommen, welche den Asylbewerber in den Augen der eritreischen Behörden als missliebige Person erscheinen lassen.

Gilt nicht für Deserteure

Der Entscheid betrifft sämtliche hängigen Verfahren, bei denen Asyl wegen illegaler Ausreise begehrt wird. Der Mann, um den es konkret ging, hat bereits die vorläufige Aufnahme gewährt bekommen und muss die Schweiz nicht verlassen. Ob seine Wegweisung in die Heimat wegen der drohenden Einziehung zum Nationaldienst als unzulässig oder unzumutbar anzusehen wäre, wurde deshalb nicht geprüft. Ebenso wenig äussert sich das Urteil zur Frage, wie mit eritreischen Deserteuren umgegangen werden soll. Das Urteil ist endgültig.
