Is it traitorous when a U.S. Senator, who represents in the U.S. Senate, only the people of his/her state, and not ANY foreign nation, takes it upon himself/herself, to threaten the only international criminal court that exists under the United Nations system, and to be threatening it, not in order to serve and protect the people of these United States, but instead to protect and serve the rulers of that foreign nation — to protect them from the possibility of their becoming convicted of international war crimes that are in violation not only of the U.N.’s Charter, but of the Geneva Conventions?


By what right, do these 12 U.S. Senators, whose jusisdiction is merely national — NOT international — threaten the members of the International Criminal Court, on behalf of the rulers of Israel, a foreign nation — NOT even of their own (U.S.) nation?


Israel is NOT a U.S. state. It is being treated in some ways as-if it were, such as by U.S. taxpayers routinely each and every year donating $3.8 billion to its Government — and this year an additional $14 billion to it.


But it is not a part of these United States, and yet in the following letter, these U.S. Senators threaten the International Criminal Court (ICC) — which, if that Court will not condemn this threat as an outrageous affront to international law and to its enforcement, this ICC won’t any longer deserve to remain, as being a part of the United Nations system — and what then will remain of the U.N., at all?


Whatever their motives are in this, these Senators are essentially foreign agents, because they are threatening the International Criminal Court with sanctions by the U.S. Government in order to protect Israel's Prime Minister. If that's any Government's business, it is Israel's Government's business, not the business of America's Government. None of these Senators legally represents Israel's Government. This threat is entirely illegal, and what they are threatening is international law itself. How, then can the U.S. Government tolerate this? Only if the U.S. Government despises international law. How can the ICC tolerate it? Only if they don't take their responsibilities seriously.

Dear Mr. Khan, 


We write regarding the reports that the International Criminal Court (ICC) may be considering issuing international arrest warrants against Prime Minister Benjamin Netanyahu and other Israeli officials. Such actions are illegitimate and lack legal basis, and if carried out will result in severe sanctions against you and your institution. 


The ICC is attempting to punish Israel for taking legitimate actions of self-defense against their Iranian-backed aggressors. In fact, in your own words, you witnessed “scenes of calculated cruelty”1 conducted by Hamas in Israel following the October 7 attacks. [Leaders of Hamas are similarly being investigated by that Court for those alleged international war crimes.] These arrest warrants would align the ICC with the largest state sponsor of terrorism and its proxy. To be clear, there is no moral equivalence between Hamas's terrorism and Israel's justified response. 


The ICC is also prohibited by its charter from proceeding in any case unless the relevant government is unwilling or unable to police themselves. You yourself have said that “Israel has trained lawyers who advise commanders and a robust system intended to ensure compliance with international humanitarian law.”2 By issuing warrants, you would be calling into question the legitimacy of Israel’s laws, legal system, and democratic form of government. 


Issuing arrest warrants for the leaders of Israel would not only be unjustified, it would expose your organization’s hypocrisy and double standards. Your office has not issued arrest warrants for Iran’s Supreme Leader Ayatollah Ali Khamenei or any other Iranian official, Syrian President Bashar al Assad or any other Syrian official, or Hamas leader Ismail Haniyeh [the ICC issued that warrant on 20 May 2024] or any other Hamas official. Nor have you issued an arrest warrant for the genocidal General Secretary of the People’s Republic of China, Xi Jinping, or any other Chinese official. 


Finally, neither Israel nor the United States are members of the ICC and are therefore outside of your organization’s supposed jurisdiction. If you issue a warrant for the arrest of the Israeli leadership, we will interpret this not only as a threat to Israel’s sovereignty but to the sovereignty of the United States. Our country demonstrated in the American Service-Members' Protection Act the lengths to which we will go to protect that sovereignty. 


The United States will not tolerate politicized attacks by the ICC on our allies. Target Israel and we will target you. If you move forward with the measures indicated in the report, we will move to end all American support for the ICC, sanction your employees and associates, and bar you and your families from the United States. You have been warned.
